What is the Telecoms Security Act (TSA)?

These requirements came into effect on the 1st October 2022 and created a telecommunications security framework imposing that the provider of a public electronic communications network or a public electronic communications service must take measures as are appropriate and proportionate in the interest of cyber security.

What is the Significance of the Telecoms Security Act?

The legislation aims to ensure that telecom providers embed strong security measures to identify and defend their networks against cyber threats AND prepare for future risks.

General duties to mitigate security breaches include:

(1) identifying the risks of security compromises occurring;

(2) reducing the risks of security compromises occurring; and

(3) preparing for the occurrence of security compromises. (Telecommunications Security Act 2021, legislation.gov.uk, 25 July 2024).

The Act directly affects telecom providers as well as service providers which in turn will influence hardware vendors and software developers. It provides an incentive for the former to adopt better security practices by enhancing their legal duties, ensuring compliance is enforced throughout their supply chain. 

Third parties, joint ventures and merged networks all fall within the scope of the Telecoms Security Act. It is important to have strong visibility over the entire network to have effective controls and assurance.

The legislation grants the UK government new national security powers, ensuring better risk management.

Tiers and Deadlines to Implement TSA Measures

The Telecoms Security Act categorises providers into different tiers based on the size of the business and annual revenue.

  • Small businesses (less than 50 million annual revenue) have no mandatory compliance requirements
  • Medium (£1 Billion – £50 Million annual revenue) and large businesses (over £1 billion annual revenue) will have had to embed and implement all measures set out by the TSA by 31 March 2028. However, there are intermediate deadlines to comply with different phases of the Act.

What are the Penalties for Non-Compliance?

The UK government intends to set severe consequences for those who don’t adhere to the new measures:

  • Financial Penalties: Telecom providers failing to meet security obligations may face substantial fines. These penalties can be up to 10% of their annual turnover or £100,000 per day, whichever is higher, Ofcom being the enforcement agency for the legislation.

 

  • Enforcement Measures: The government has the authority to take enforcement actions against non-compliant providers. These measures can include imposing restrictions, issuing directions, or even revoking licenses.

 

  • Reputation Impact: Beyond financial penalties, non-compliance can harm a provider’s reputation and affect customer trust and business relationships.
